Before you hire one of Kennedy Purple’s fabulous products, we suggest you have a read through these – they’re basically some rules and regulations that relate to your hire and our company and will help you have a clear idea of how it all works. You will be required to confirm that you have read these before you can proceed with your rental, and they represent a legally binding agreement between yourselves and Kennedy Purple Ltd...so get reading!
TERMINOLOGY
For the purpose of our website, mail and of course our Terms & Conditions, the following ‘Kennedy Purple', ‘Kennedy Purple Ltd’, ‘the company’, ‘we’, ‘us’, ‘the site’, ‘our', ‘the website’, ‘the company’, or www.kennedypurple.com (or .co.uk, .net, .org, .org.uk) all relate to us – Kennedy Purple Ltd .
WHO DO THESE TERMS AND CONDITIONS APPLY TO?
These Terms and Conditions apply to everyone who uses the Kennedy Purple website, and to anyone who either becomes a member (paid or otherwise), or who wants to rent a Kennedy Purple item. Once a user becomes a member they are obliged to adhere to these Terms and Conditions entirely. This is a legally binding agreement between Kennedy Purple Ltd and its users.
WHO WE ARE AND WHAT WE DO
Kennedy Purple Ltd is an e-commerce website which rents designer products for a fee. We are a limited company registered and based in Scotland, UK. Kennedy Purple Ltd is registered at Companies House and our company number is SC363803
MEMBERSHIP RULES!
- Members must be at least 18 years old
- Members must have a valid bank account and / or debit or credit card that they can make their payments with via our payment gateway site Paypal – either for individual rentals, or for the cost of their monthly membership (where applicable)
- Members must provide these credit or debit card details to Kennedy Purple Ltd when necessary or as requested, and agree to the terms of use for these cards, including agreement for Kennedy Purple to invoice to you, the user, reasonable charges to this card as detailed throughout these Terms and Conditions
- Proof of identity may be requested when a member wishes to hire an item, and credit checks will be performed at the discretion of Kennedy Purple. This term is further detailed within this page
- Proof of identity can include – images of acceptable forms of ID, such as a passport, or driving license, as well as clear images of the credit or debit card that the user wishes to use to make their payment, or payments. This information will be kept private in accordance with UK law and with our Privacy Policy
- Members must be permanent UK residents, and have a valid UK address for deliveries to be made. Their delivery address must be the same as their cardholder address
- Paid Membership is currently £15 a month – this is subject to change, but paid members will be informed before any such changes are implemented.
- Only members may hire an item – they may not hire on behalf of another person or party
- Kennedy Purple Ltd reserves the right to refuse membership or hire of an item at their discretion
- Members must adhere to the Terms and Conditions of Kennedy Purple, and to any Scottish or English Law relating to the type of site that www.kennedypurple.com is
- Non-members will not be permitted hire of any item on the site.
PAID MEMBERSHIP
When a person signs up to be a paid (VIP) member of Kennedy Purple, they agree that they will pay the monthly membership fee of £15. This will be debited from their account on a monthly basis following successful completion of a Standing Order form and instruction to their bank or building society. Members may pay in advance, however a standing order will still be set up immediately, although not used immediately but commencing on the date from which the membership is due to commence payment.
Payment will be taken on a monthly basis, on the monthly anniversary that paid membership began, or on the nearest working day if this is not possible.
MEMBERSHIP – GENERAL
Kennedy Purple reserves the right to refuse membership on any basis. An explanation of the reasons for refusal cannot always be given, but may be requested.
CREDIT CHECKS
Kennedy Purple reserves the right to run credit checks on all members who wish to hire an item from their site if the company deems it fit to do so.
OWNERSHIP
Each item available on www.kennedypurple.com belongs to Kennedy Purple Ltd, even when in the possession of a member.
CARE OF THE ITEM HIRED FROM KENNEDY PURPLE LTD
Members must take due care and attention when hiring an item from Kennedy Purple Ltd. Members must not alter any item that they hire. Equally, they may not re-hire, sell or attempt to sell any items which belong to Kennedy Purple Ltd. Members must return the item they have hired in a reasonable and good condition.
MEMBER'S LIABILITY
If an item hired from Kennedy Purple Ltd is damaged whilst in a member’s possession, the member is liable for any costs incurred. Theses include costs of repair, and any costs lost through the item being unavailable to other members whilst being repaired. It is in the company's best interest to have items fixed as quickly as possible and shall always endeavour to do so. Where an item cannot be repaired the member will be liable for the full cost of a replacement bag, even if the bag is no longer available to purchase.
FINANCIAL INFORMATION
Members' financial information is used and held in a manner wholly appropriate to the site. For more details please read our Privacy Policy. Members are subject to financial credit checks through Experian or other UK based credit reference agencies – these credit checks are carried out at the discretion of the company.
PAYMENT FOR ITEMS
All members must pay the amount as stated for the chosen hire period of the item they have chosen to hire, as well as postage costs. This payment must be made upfront. No item will be dispatched until payment has been made.
ADDITIONAL PAYMENTS
It is at Kennedy Purple’s discretion that they may require to take additional deposit amounts prior to dispatch of an item. Users will be informed before such charges are requested.
NON-PAYING MEMBERS
Non-paid membership is available with Kennedy Purple. If a non-paid member wants to hire an item, as well as debiting the full amount for the cost of the hire, either a deposit or the full recommended retail price of said item may be required. In these instances, Kennedy Purple Ltd will agree this with the customer and this amount will remain with Kennedy Purple Ltd until the item is returned to us within the chosen period and in good condition. If the item is not returned within this period, the amount will only be returned/partially returned at Kennedy Purple’s discretion and only when the item is returned as per the above (within the appropriate period, in good condition, and confirmed as the original item was sent out, and owned by Kennedy Purple Ltd).
PAYMENT FOR ORDERS
By placing an order for an item through Kennedy Purple Ltd, the user/member agrees to pay the amount stated, for the period stated/chosen. Payment is made via our elected payment gateway, Paypal. Their own Terms and Conditions can be read here.
BANK ACCOUNT, DEBIT AND CREDIT CARD DETAILS
By joining Kennedy Purple Ltd, and by providing the Company with details of your bank accout, credit or debit card, you authorise the Company to process charges to said card or account e.g. for membership fees, deposits, payment of invoices for hires, late fees (as detailed within these terms), damage/loss charges as detailed below (this list is not exhaustive). This authorisation will continue until termination of the membership (either by the user or by Kennedy Purple Ltd) and once all outstanding amounts have been paid in full, and all items returned to Kennedy Purple Ltd in accordance with the hire duration, in good condition, and meeting these terms.
TERMINATION OF MEMBERSHIP BY KENNEDY PURPLE LTD
Kennedy Purple reserves the right to terminate any membership at its own discretion. The Company may permanently terminate, or suspend any membership. This will most certainly be done if these Terms and Conditions are not adhered to, or if a member abuses, or attempts to abuse either the site, the Company, or the products.
TERMINATION OF MEMBERSHIP BY CUSTOMER
The customer has the right to cancel their membership with Kennedy Purple Ltd. The customer must inform Kennedy Purple if they wish to terminate their membership, and any membership costs incurred up to this date will still be charged. Paid members must inform Kennedy Purple at least two full weeks prior to their next due payment. If this is not adhered to, a member will be liable to pay the next payment before membership can be terminated. A membership will not be terminated until all items in the member’s possession are returned to Kennedy Purple in the condition described throughout these terms.
ADDITIONAL ITEMS INCLUDED IN ORDER
When an item is dispatched to a member, it will sometimes include dustbags, authenticity cards, care instructions, and appropriate packaging – boxes, bags etc. These must also be returned when the item is returned to Kennedy Purple Ltd. If these are not, the member will be charged a replacement fee to be determined by Kennedy Purple Ltd. Items which may be kept by the member will be detailed when the item is dispatched, and/or within the paperwork included in the package. These may include, make-up bags, samples and business cards etc.
AUTHENTICITY
All items stocked by Kennedy Purple Ltd are authentic and sourced direct from the manufacturer, or their recommended retailers. If requested, Kennedy Purple Ltd will provide proof of authenticity, and proof of purchase where possible.
EXTENSION OF HIRE PERIOD
Extension of a hire period may be requested through Kennedy Purple Ltd, and whilst not always available, will be agreed or denied at the discretion of Kennedy Purple Ltd, and if agreed, a further order must be placed and agreement made between the member and the Company.
PERIOD AND DURATION OF HIRE
When a member places an order through www.kennedypurple.com they will choose the start date for their hire, and the duration of their hire period through the Kennedy Purple website diary function. At the end of the agreed hire period, the item must be received by Kennedy Purple Ltd within 1 working day of the hire end period. Returns received after this date will be subject to a charge for the next full hire period. ie. if a member hires an item for a month until the 25th, and the item is not returned (received at Kennedy Purple Ltd) until the 27th, a full additional week's / month’s hire cost will be debited from the members debit/credit card. When a booking is made, a confirmation e-mail will be sent detailing dates and duration of hire period. A further e-mail will be sent when the item has been dispatched. A reminder e-mail will be sent when the end of the hire period is approaching. All details of the hire period will also be detailed in the documentation which will be sent to the customer with their chosen item.
The minimum chargeable hire period is 1 week. For bookings under 1 week in length, the cost shall be for an entire week.
COPYRIGHT
All text, graphics, design elements and stock images on the Kennedy Purple Ltd website belong to Kennedy Purple Ltd and should not be copied without permission from Kennedy Purple Ltd. Such copyright infringement is strictly prohibited, and will be dealt with accordingly.
RETURN OF KENNEDY PURPLE ITEMS
When a member places an order to hire an item from Kennedy Purple Ltd, they agree to return the item within the hire period, and in good condition. This is the responsibility of the member.
LOSS/THEFT OF AN ITEM
If an item is lost or stolen whilst in the possession of a member, that member is liable for the full replacement charge of the bag – usually its recommended retail price, along with a possible additional charge to cover any further losses made by Kennedy Purple Ltd through being unable to carry out its future hire agreements. We recommend that members add the hired item to their personal home insurance for the duration of the hire period. If an item is stolen, we recommend it is reported to the police, and a crime reference number obtained. However, even if these measures are taken by the member, they will still be fully and immediately liable for replacement costs.
DAMAGED ITEMS
If an item is damaged whilst in the possession of a customer, that customer will be fully liable for all costs incurred to repair the item. Such damage could include broken hardware (zips, buckles, catches, chains etc.), tears and rips to material on any part of the item, loss of stones in jewellery items, broken chains for jewellery items, and damage caused by smell (i.e.smoke), which will incur the charge for the item to be professionally cleaned. This list is not exhaustive, and it is at the discretion of Kennedy Purple Ltd that any damage will be assessed. Kennedy Purple Ltd will keep these costs to a minimum where possible, but repairs must be done to a high standard and costs will reflect this. Also, if damage is caused, and the ensuing repairs causes Kennedy Purple Ltd to lose further income from bookings which need to be cancelled, the customer who had the item in their possession will be liable for any lost income to Kennedy Purple Ltd. If an item is damaged to the point where it cannot be repaired, or the cost of repair is greater than the full price value of the item, the customer will be fully liable for the cost of replacement of the item, which will be the full RRP. This remains the case even if the item is no longer available to purchase.
INSURANCE
Whilst Kennedy Purple Ltd has all items in our stock insured whilst with Kennedy Purple Ltd, the insurance does not cover the items when they are out on hire. Details of what customers are liable for are detailed above. Kennedy Purple Ltd highly recommends that customers temporarily add items to their own insurance for the duration of the hire period, although we cannot insist on this.
DELIVERY
Kennedy Purple Ltd uses Royal Mail Special Delivery and Parcelforce for delivery of their items to customers. When a customer returns an item, they must use the same service. When the customer is a paid / VIP member, postage costs incurred by the customer shall be refunded to the customer by way of a discount code for the value of the postage paid by the customer - the discount code will be valid for 3 months. This is only the case when the customer is a paid / VIP member. Customers who do not pay our monthly membership fee are liable for all postage costs. Proof of postage is required to be shown to Kennedy Purple Ltd in order to receive this discount code. If an item is not returned by the return date, the customer will be charged either another period of rental OR the full value of the item until it is returned. At this time, a refund may be issued, minus any losses, or potential losses from Kennedy Purple Ltd. Until the item is returned in the condition stated above, the customer is financially responsilbe for it. If the item is lost on it's return to Kennedy Purple Ltd, the customer is liable for replacement costs.
DISCOUNT CODES
Kennedy Purple Ltd issues discount codes of various values. Each code will have an expiration date, and cannot be used outside this period. Discount codes are given at the discretion of Kennedy Purple Ltd, and they have the right to cancel these codes at any time.
RETURN OF ITEMS
All items MUST be returned by the agreed date, and in the condition the item was dispatched in. Occasional and reasonable wear and tear, as decided by Kennedy Purple Ltd is expected, and taken into account if ever any assessment of damage needs to be carried out. Each item is fully inspected before it is sent from Kennedy Purple Ltd to the customer, and on its return to Kennedy Purple Ltd.
CONFIDENTIALITY AND PRIVACY
All confidentiality and privacy issues are fully detailed in the Kennedy Purple Privacy Policy. Any communication between Kennedy Purple Ltd and its customers is treated as confidential, and only for Kennedy Purple Ltd, its partners or its customers.
MEMBERSHIP DETAILS
Kennedy Purple Ltd recommends that all members keep their personal information that relates to their Kennedy Purple Ltd account private, and it is their responsibility to do so. If a member has concerns about the confidentiality of their details, we recommend that they read our Privacy Policy, and if there is still a concern, contact Kennedy Purple Ltd.
WEBSITE PRIVACY
As previously described, the design, copy, graphics and stock images used on the site belong entirely to Kennedy Purple Ltd, and should not be copied, or used without permission from the Company. Similarly, it is strictly prohibited for anyone other than Kennedy Purple Ltd and their chosen associates to try and interfere with the design, layout or working of the website. This includes its servers, hardware, software, networks etc. The site cannot and must not be used to try and communicate, distribute or transmit any unauthorised information. No information may be uploaded to the site without the express permission of Kennedy Purple Ltd.
DEBT RECOVERY
If ever Kennedy Purple Ltd has to use a debt recovery agency to recover outstanding amounts from a user or customer – that user or customer will be fully liable to cover any costs paid by Kennedy Purple Ltd to employ such agencies or parties. This may happen when a customer does not adhere to these Terms and Conditions.
MISTAKES AND OMMISSIONS
Any mistakes and omissions on the Kennedy Purple Ltd website are not intentional, and will be rectified as soon as possible after they are discovered.
CHANGES TO TERMS AND CONDITIONS OF USE, AND OF WEBSITE
Kennedy Purple Ltd reserves the right to change or modify both its website and its contents, as well as these Terms and Conditions at any time it sees fit or requires to. Whilst Kennedy Purple Ltd will try to always inform members of changes to the Terms & Conditions, it is not obliged to, and it is the responsibility of the users to read Terms and Conditions on a regular basis. All changes to Terms and Conditions, or any aspect of the site, such as cost of items will have immediate effect from when they are added. With regard to hire cost charges, this will not affect fully paid, pre-booked bookings.
IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS
Hire of products from Kennedy Purple Ltd is only allowed on agreement with these Terms and Conditions in full and without exception. If a user disagrees with any of these, Kennedy Purple Ltd would recommend they terminate their membership. Alternatively Kennedy Purple Ltd reserves the right to terminate memberships at any time, including if a member disagrees with the Terms and Conditions of use of the site, or in any way which contravenes these terms.
USE OF IMAGES
The Kennedy Purple Ltd site uses images within its content. Stock images have either been commissioned by Kennedy Purple Ltd and are for the sole use of Kennedy Purple Ltd, or express permission has been granted to use them from elsewhere. Alternatively they have been provided by the manufacturer of the products. Images of magazine pages, and of celebrities are not copyrighted by Kennedy Purple Ltd, and do not in any way suggest or claim that endorsements have been made by manufacturers, celebrities, their agents, management, or by magazine publishers. Credits for these pictures are included in the copy of the site where possible.
WHERE KENNEDY PURPLE DISPATCHES TO
Kennedy Purple Ltd is a UK based company, and as such currently dispatches items within the UK only. Items must be dispatched to the billing address of the customer, unless agreed by Kennedy Purple Ltd prior to hire period. It is at Kennedy Purple Ltd’s discretion whether an agreement of this type can and will be made.
GIVEAWAYS
Kennedy Purple Ltd will occasionally offer giveaways relating to certain products. All such offers are subject to availability, and entry to such offers is allowed or prohibited at the discretion of the Company.
PRICING STRUCTURE
The pricing of all items, and any price structuring on Kennedy Purple Ltd is chosen by the Company, and is subject to change at any time. Such charges shall have immediate effect, and are made entirely at the discretion of Kennedy Purple Ltd. Items will be charged at the price the customer paid in full when making their hire booking.
NUMBER OF ITEMS AVAILABLE
The number of items available at any one time, or to any specific member is subject to alteration at the discretion of Kennedy Purple Ltd.
MEMBER INFORMATION
By providing Kennedy Purple Ltd with personal information, and agreeing to these Terms and Conditions, you also agree that all such information is correct, accurate and complete. If this is not the case, Kennedy Purple Ltd reserves the right to terminate membership, and demand any outstanding items to be returned to Kennedy Purple Ltd. Customers in this situation will still be liable for the full agreed cost for the full hire period.
